The text is dedicated to the analysis of the legal regulation of military wills in the new Civil Code (Law No. 89/2012 Coll.). It places it in a historical legal context. However, priority attention is paid to a detailed analysis of the current legal regulation and potential issues that this regulation brings. It also briefly mentions other options for last dispositions that a soldier could use. The legal regulation of military wills in the Civil Code can be characterized as very well conceived, reflecting the reality of foreign missions. The fact that it takes the form of a public document is also significant if the relevant requirements are met. However, the question is how the application practice of the courts will approach the adjustment.

Resistance Operating Concept as a Tool for Increasing the Resilience of the State

The article describes the issue of implementing the Resistance Operating Concept as part of a comprehensive approach to ensuring the defense of the state and its resilience. The basic conditions necessary for the introduction of that instrument are sought, and a comparative analysis of selected European countries that started to build a resistance movement is carried out. The article further describes the strategic definition of the resistance movement in the conditions of the Czech Republic, the legislative definition of the resistance movement and its anchoring in the framework of mental law, and the connection of the resistance movement to individual phases of the conflict. It analyzes the relationship of the resistance movement to individual phases of the conflict and categorizes the actors of the resistance movement, their roles and the methods used. In conclusion, it defines the necessary conditions for the implementation of the resistance movement into the security and defense system of the state.

Proposal of Legal Status of the Expert Valuation Institute Objectifying the Acquisition Process

The process of procuring military equipment, technology, material, and associated services (VM) is frequently shrouded in concerns about cost-effectiveness and, in some instances, even becomes the focus of law enforcement investigations. This often leads to delays in strategic investments and exposes involved individuals to the risk of criminal charges. Additionally, there is a notable lack of capacity to impartially evaluate the overall investment's efficacy. Consequently, the "Znalec" (Expert Witness) project was initiated as a part of the defense research program. Its objective is to explore the feasibility of establishing an expert institute that could impartially assess the value of the military procurements, set a standard for evaluating these assets, and outline a training program for relevant experts. This paper specifically addresses the first objective of the project, proposing a legal framework for the expert institute based on an extensive systems analysis.

NATO Support and Procurement Agency: a Powerful Instrument of Collaborative Logistics

The paper evaluates the level of cooperation between the Ministry of Defence and the NATO Support and Procurement Agency (NSPA) in the field of procurement of military equipment. In the practical part, the results of the research on the level of participation of Czech-based suppliers in NSPA activities between 2018 and 2022 are presented. Pareto analysis comparing the participation of the Czech and international companies in contracts implemented by NSPA in terms of their subject, quantity and financial value is used. Qualitative case studies from three different areas illustrate in which NSPA projects the Czech Republic has already been involved in and which benefits and risks are associated with this cooperation for the MoD. Positives and drawbacks in the process of acquiring military equipment in-house and opportunities and threats that may arise from the acquisition of military equipment through the NSPA are summarised in the form of the SWOT analysis. Finally, recommendations are presented on how to improve the cooperation between the MoD and the NSPA in the field of acquisition.

Some Legal Aspects of Western Military Aid to Ukraine

The article deals with the some legal aspects of Western military aid to Ukraine. The first part briefly analyzes the Russian Federation's attack on Ukraine from a "just war" perspective. The following part is devoted to individual perspectives of different branches of international law on military aid to Ukraine - the law of neutrality, ius ad bellum, ius in bello, issues of co-belligerency and state responsibility for complicity in internationally illegal actions. The conclusion summarizes the findings and gives an answer to the question why Western aid to Ukraine mostly does not violate the norms of international law.

The annual examination is an integral part of the physical training system of a soldier of the Army of the Czech Republic, which assesses his physical fitness. This assessment provides dual feedback - it informs examinees of how they are performing against normative tables and each other, and at the same time, gives commanders an idea of the current physical fitness of their subordinates. This thesis focuses on the endurance event of the 12-minute run (also known as the Cooper test). Based on data from 2011 to 2021 and nearly 50,000 evaluated tests, the potential effects of age on soldiers' physical performance and appropriate adjustments to individual age limits were examined. The analysis showed that the difficulty setting for achieving the same rating differs for both genders and that there is a different decline in physical performance with increasing age than reflected in current norms. Based on these analyses, a proposal for modifications to the annual physical training test was developed and is appended to this paper.

The article deals with the comparison of refunds of non-material damage in public and private area. In the public area is analyzed legal regulation on health injuries in service relations, in private area is discussed legal regulation on health injuries in civil law and labour law. Particular attention will be focused on the transfer of compensation in the event of injury to the heirs - while in service relationships, such claims are extinguished by death (not transferred on the heirs), which was taken over from the 1960s legislation, in current private law, do not cease if they have been recognized or at least brought in court. The aim of the paper is a critical analysis for the current state of legal regulation and the proposals de lege ferenda (approximation to labour law regulation). The issue has increased importance for public finances and functioning of public sector and enforcement of the rule of law.

This study provides a summary overview of the creation and the activities of the international security architecture in the form of their two main pillars, i.e. the United Nations and the North Atlantic Treaty Organization in the Near and Middle East region. Within the framework of international security relations, this is a very unstable and conflictual region, where this instability has lasted practically since the establishment of the State of Israel in 1948. The global UN, its overall activity and importance, especially humanitarian and peace-building activities not only for the Near and Middle East region, is very beneficial, through out the Cold War period up to the present day. As a security organization, NATO is among the most important global actors influencing current international security relations. Through their activities, both of these organizations represent a essential means of ensuring world peace and security.

Does the government's defence funding bill really only create an unenforceable political commitment?

The article is devoted to the draft law on defence financing, which aims to oblige the government to allocate an amount of at least 2% of GDP to defence in every draft law on the state budget. During the inter-ministerial comment procedure, the Supreme Audit Office expressed doubts whether the draft means anything more than an unenforceable political commitment in relation to the Chamber of Deputies". The article convincingly demonstrates, with the help of legal argumentation and interpretation of the Constitution of the Czech Republic, the Rules of Procedure of the Chamber of Deputies, as well as the established case law of the Constitutional Court of the Czech Republic, that if approved, the Chamber of Deputies will also be bound by the Defence Financing Act when approving the state budget. To do otherwise would violate constitutionality.

The Armed Forces in Institutional and Functional Concept

The article deals with the interpretation of the term "armed forces" in the context of the current legal system of the Czech Republic. The authors propose to distinguish between the armed forces in the institutional concept and in the functional concept. The essence of the solution is the interpretation of Section 3(1) of the Armed Forces Act (No. 219/1999 Coll.) in the functional concept, i.e. in such a way that the armed forces are understood to include soldiers assigned to the Ministry of Defence, military schools, the Military Police and the Military Intelligence. Another solution could be to add a paragraph to the Armed Forces Act stating that "The provisions on members of the armed forces shall apply mutatis mutandis to soldiers on active service assigned to the Ministry of Defence, military schools, the Military Police and the Military Intelligence." The aim of the article is initiation professional discussions about the issue in question, as well as indications of directions as to how it would be appropriate to solve the matter.

The Path to Bucha: Organisational Practices of the Russian Army and Violence against Noncombatants

The Bucha massacre raises the question of whether the Russian army predisposes its soldiers to unlawful violence against civilians. This article assumes that regardless of superior orders, perpetrators of violence must overcome the psychological barriers developed during socialisation. The psychological mechanism of "moral disengagement" allows soldiers to kill in combat and act violently on civilians. The duty of the armed forces is not only to prepare soldiers to fight and kill but also to prevent illegal violence. The case of the Russian army demonstrates how formal activities to prevent moral disengagement and violations of the International Humanitarian Law (IHL) face insurmountable obstacles in the form of institutional culture and insufficient human capital.

The article deals with the preparation of the Active Reserve of Czech Armed Forces, territorial forces in detail. It compares them to the equivalent of the active reserves of the Polish army, namely the Territorial Defense troops. A comparison of the development and preparation of these forces points to the necessity of solving or updating the system of calling up reserves of the Czech Armed Forces, their training, arming and equipping.

The "Women, Peace and Security" Agenda and Integrating Gender Perspective in the Environment of the Armed Forces of the Slovak Republic

The measures adopted on the soil of the North Atlantic Alliance to support the integration of gender perspective are discussed in the article, as well as the way in which these were subsequently reflected in the legislative measures of the Ministry of Defense of the Slovak Republic and examines the approach of the Armed Forces of the Slovak Republic (hereinafter referred to as "OS SR" ) to the integration of gender perspective. The article further focuses on how the OS SR integrate and support these principles in the real life of professional soldiers. The analysis of available statistical data as well as of research previously conducted in this area serves as a basis for formulating conclusions on whether the Slovak Republic fulfills its obligations regarding the integration of gender perspective towards the North Atlantic Alliance, and at the same time formulates starting points for possible future research.

The use of NATO Evaluation Tools for the Assessment of the Czech Land and Air Forces Preparedness

The article deals with the method of application of evaluation tools, applicable for the evaluation of the preparedness assessment of undeclared headquarters and units of the Czech Armed Forces. As a part of the research there were analysed the approaches of the Czech Republic and NATO using of a comparative analysis supplemented by a structured interview. The results of the research confirmed the inconsistent approach to the application of standardized tools and methods for evaluation of units, which are not declared for the NATO and the EU Task Forces. Based on the results of the analysis and with the utilization of the best practice approaches, there was formulated an innovative approach to assessment of the required capabilities of all headquarters and units. The evaluation of these preparedness is carried out at the end of each Czech Armed Forces operational training cycle.

The Revolt of French Soldiers Against the Failing Immigration Policy

The article is about the revolt of French soldiers against the failing immigration policy of their country. It explains its rational causes at the historical, geopolitical as well as security levels. It analyses its three main acts since 2013 until today and presents their key actors: the high level generals and politicians. These acts are presented as historical accidents. The article shows that French soldiers refuse to be silent face to face big stakes, especially on the field of defence of the Republic against the growing violence of young immigrants. The text continues with the analysis of two manifests of French soldiers from spring 2021 that evoke the threat of the civil war in France and the role of the Armed forces in such a scenario.

Leadership development in the conditions of the Czech Armed Forces

The aim of this article is to define leadership as a process required in the Czech Armed Forces. To this end, the nature of military leadership is first identified by analyzing similarities and differences of the widely accepted theoretical concepts (schools) of leadership, including approaches used in selected alliance armed forces. Based on the current state of affairs analysis, the components of leadership and the relationship among them are identified, as well as general conditions for their application. In accordance with the knowledge gained, a general leadership model of the Army of the Czech Republic is proposed.

National Defense and Environmental Protection: On the Czech Armed Forces´ Approach to the Development of Environmental Legislation in the Czech, EU and NATO Context

The aim of this study was to create an overview of the Czech Armed Forces' development in approach to environmental protection from 1989 to 2022. Using the methods of analysis, synthesis and comparison of the Czech, EU´s and NATO´s environmental legislation, we created a comprehensive and previously unpublished overview of environmental protection within the Czech Armed Forces. Found outputs were set into illustrations depicting the activities in the environmental field with internal links between civil legislation, EU's requirements, and NATO's policy in chronological order. We conclude that the year 2000 represents a key milestone from which the approach to environmental protection have stagnated. Among the reasons for the stagnation, we identify commanders' concerns about "green approach" to troop training and the lack environmental education within defence department.

Concepts of the Hybrid Warfare and the Czech Armed Forces

The goal of this review article is to briefly describe the development trends in the conceptualization of the phenomenon of hybrid warfare and to try a basic comparison of the key features of twenty important concepts with emphasis on selected Western, Russian and Chinese theoretical concepts. A substantial part of the article also deals with a closer characterization of hybrid warfare with the intention of clarifying the possible relationship of this type of warfare to the activities of the Czech Armed Forces. In connection with the importance of hybrid warfare and hybrid threats, the article is supplemented with essential recommendations that the Czech Republic and the Czech Armed Forces should reflect. The emphasis on content and the above arguments confirm that looking at the phenomenon of hybrid action and warfare as a novelty is very debatable. Rather than a new concept of warfare, it is a newly accentuated term "hybrid" describing long-known combinations of power tools used.

Human Resources of the Mobilization of the Czech Armed Forces at the Beginning of the 21st Century

The article focuses on identifying the key factors of human resources within the Czech state needed to carry out mobilization of the armed forces in case of a military conflict. It primarily answers the questions of whether these factors are sufficient and can be used effectively in the mobilization process. It addresses the issue of military records, sustainability of military reserves and their profitability. It also deals with the influence of secondary factors on the possibilities of creating and training reserves, especially the motivation of citizens to defend the state and the physical fitness of the mobilized population.

Long-term Monitoring of Physical Fitness of Soldiers from a Specialized Part of the Czech Armed Forces

This study deals with long-term monitoring of physical fitness of soldiers, namely members of the 31st Radiation, Chemical and Biological Protection Regiment in order to determine whether the annual fitness test has rising trend, or in another words, whether the military service physical training process is fittingly effective. The study was carried out by comparing the assessment of physical fitness each year 2012-2019. The monitored group consisted of 316 professional soldiers, who participated in this assessment regularly, without interruption in the same disciplines.
Due to the managed long-term military physical training process, overall improvement in the strength and endurance disciplines throughout the monitoring period took place.
Based on the acquired data, it may be stated that the annual testing showed rising trend and thus the efficiency of the in-service physical training process proved to be good and appropriate.

The authors offer the research outcome focusing on the assessment of risk management practices applied in the Armed Forces development planning process. Based on analytical outcomes, contemporary theory and best practices authors outline comprehensive approach to risk management within the Armed Forces development planning process. The purpose of the article is to enhance effectiveness of existing managerial process and elevate risk management from rather administrative exercise to effective management tool in the time of growing level of uncertainty. As the most suitable instrument, the Risk Management Plan is developed including the necessary implementation measures within the Armed Forces of the Czech Republic.

Current Problems and Needs of Modern War Veterans (sociological research)

The paper presents selected knowledge and findings of the sociological survey, which was focused on identifying the needs and problems of modern war veterans leaving the military service in 2018. The findings of the research point to recurrent problems in communication and information transmission to the ending soldiers in their service as well as the lack of information in relation to the resort's offers of care and assistance to war veterans. The subjects involved in the war veteran care system do not always have full current information, which may lead to negative reactions and attitudes of some military personnel that the setting system does not adequately respond to soldiers' problems and needs, especially before leaving military service.

American Military Doctrines of New Generation

The article is based on the neorealist theory and is aimed to the analysis of the military doctrines of the USA published between 2012 - 2018. It evaluates them as the consequence of important changes after the end of the Cold War, namely the process of the enlargement of NATO. The article explains the US doctrines as a manifestation of a reinforced military self - esteem of the USA and warns that these doctrines should lead to an increase of the military tension at the Eastern frontier of the enlarged NATO.

Defining and Evaluation of Competencies of an Officer of the Czech Armed Forces

The article deals with the issue of identification and evaluation of the competencies of senior officers of the Czech Armed Forces. Paper investigates the role of the authorities responsible for military branches and military occupation specialties in the system of defining officer´s competencies. It was also examined the scope of possible application of the competency model of a professional soldier defined by the National System of Occupations in the process of career management. As a comprehensive and optimal solution, a full application of competency model is proposed. The partial application of the competency model is based only on the use of the soft competencies component. Both of these proposals are formulated primarily for the purpose of describing the job position and official evaluation. The paper also brings a number of proposals in the conceptual and normative area circumscribing and strengthening the role of the responsible authorities in the process of defining the officer´s competencies.

The Czech Armed Forces' professionalization is an underlying qualitative change and its realization is not without risks. This paper outlines the political origin of this phenomenon, characterises the coherence with the transformation of the Alliance and illustrates overseas experience with some recruitment problems, namely the NCOs, the limits of women in the armed forces, the role of voluntary reserve force, and the substantiations for compulsory military service generally. The purpose of this essay is to draw attention to less known pitfalls of this process, with wide connexions, going beyond regular professionalization frames, defined as a task carried out by the military personnel department.

The paper deals with the professional development of cyber security corps. In the introduction the individual elements that are active in cyber security are described. Strategic analysis of the education is carried out to define the initial state. The main part of the paper is devoted to the design of the education system. The individual elements are defined in the paper, and the model of relationships between these elements is shaped. The attachment contains complete set of topics and their classification into the strands to fulfil the profile of the cyber security expert.

The article deals with approaches and tasks of education in the field of security and state defence of the Czech Republic. It is based on the legal framework and informs the professional public about the initiative and process of the Ministry of Defence of the Czech Republic and Ministry of Education, Youth and Sports of the Czech Republic in particular area. Preparation of citizens for state defence conception, which was approved by the resolution of the Government of the Czech Republic on the 1st April 2019, reacts to results within the implementation of this Conception adopted in 2013 and reflects an unsatisfactory situation in its realization. It deals with new approaches and tasks of education in the field of security and state defence.

Partisan and paramilitary groups operating on Colombian soil have been representing a serious regional security threat for the last fifty years. The most successful attempt to conclude a peace treaty between the government and the insurgents is represented by the peace process that took place between 2012-2016. This process resulted in the agreement between the colombian government and the guerilla group Fuerzas Armadas Revolucionarias de Colombia - Ejército del Pueblo. This paper deals with the dynamics of the of the peace processes between the government and guerilla groups and analyzes the factors contributing to the escalation and deescalation of the conflict and factors that enabled or on the contrary disabled a successful demobilization of the insurgents. The analysis of the demobilization uncovered a number of factors indicating a contradictory acting of both sides of the conflict. While the adversaries were negotiating the peace agreement, in the same time they were violating the previous agreements. Such behaviour was caused mainly due to the absence of a strong sponsor.
