Clarifying the Notion of Direct Participation in Hostilities (The Protection of Civilians)Military lawRNDr. Marek Jukl, Ph.D.Vojenské rozhledy / Czech Military Review Nr. 3/2010, Vol. XIX. (LI.): 168-180 International humanitarian law hinges on the principle of the distinction between combatants, whose function is to conduct hostilities during armed confl ict, and civilians, who are presumed not to be directly participating in the hostilities and, therefore, entitled to full protection from attack. They lose this protection only if, and for as long as they "directly participate in hostilities". After several years of expert discussions and research, the International Committee of the Red Cross (ICRC) has published the Interpretive Guidance, which aims to clarify the meaning and consequences of direct participation in hostilities under international humanitarian law (IHL). This article is devoted to the explanation of this notion. The presented interpretation follows the Interpretative Guidance published this year. |

Czech Professional Armed Forces: Short Look Back in the PastInformational pagesMjr. Ing. Bohuslav Pernica, Ph.D.Vojenské rozhledy / Czech Military Review Nr. 1/2008, Vol. XVII. (XLIX.): 94-96 In 1990 we expected that the Czechoslovak Army could be fully professional, around the year 2005. The process of professionalization was successfully finished after 15 years, by the successive state that replaced the former Czech and Slovak Federative Republic?the Czech Republic. This article follows the tracks of professionalization process. In accordance with the share of conscript soldiers, K. W. Haltiner divides armed forces into four types: (I) army fully dependent on conscripts; (II) nearly 2/3 conscripts; (III) less then one-half conscripts, army is not dependent on them; (IV), fully professional army. As the graph shows, the pace of professionalization was slow, for a very long time the ACR belonged to type II then the Czech army used to be type III. The author leaves the question ?whether the professionalization is forever? opened. |

Russia's Influence on the Conflict Dynamics in Nagorno KarabakhReviewed - ReviewPavlína BláhováVojenské rozhledy / Czech Military Review Nr. 3/2017, Vol. XXVI. (LVIII.): 3-13 | DOI: 10.3849/2336-2995.26.2017.03.003-013 Frozen conflict in Nagorno Karabakh has been representing a threat to the regional stability for the last two decades. Sudden escalation of violence in 2016, known as Four-Day War, spurred new discussions on factors influencing the territorial dispute between Armenia and Azerbaijan. While adversaries explain the conflict as a reaction to military provocations or as a rally round the flag effect, this article explains the dynamics of the conflict through the influence of the third party - Russia. Russia considers the Caucasus to be its sphere of the influence and therefor aims to spread its control through strengthening strategic ties with both Armenia and Azerbaijan in order to prevent the West from projecting its power in the region. Russia's role of the superpower has therefor a vast influence on the Nagorno Karabakh conflict development. |

The article outlines several practical recommendations to the Czech Republic in the area of military capabilities, armaments, defence research, defence industry and market, which could provide guidance in this process. |

Methodologic Framework for Military Capability Assessment of Armed Forces of the Czech RepublicReviewed - ReviewZdeněk PetrášVojenské rozhledy / Czech Military Review Nr. 2/2017, Vol. XXVI. (LVIII.): 3-17 | DOI: 10.3849/2336-2995.26.2017.02.003-017 The aim of the article is to present a synthesis of findings from both analyses and their application while conceiving a proposal of methodology for military capability assessment of Armed Forces of the Czech Republic. The proposed approach to capability assessment stems from principles of the NATO´s J-DARTS (Joint Defence Planning Analysis and Requirements Tool Set) and EU´s SAEP (Scrutinising, Assessing, Evaluating and Prioritising Process) when the main attention was focused on the phase of matching current capabilities of force units against capability requirements, follow-on identification of shortfalls and their prioritisation. The degree of priority should primarily qualify the level of operational risk stemming from potential engagement of force units in an operation. |

Strategic Documents of the Czech Republic and Ministry of Defence AcquisitionsReviewed - ReviewIng. Antonín Novotný, Ph.D.Vojenské rozhledy / Czech Military Review Nr. 3/2016, Vol. XXV. (LVII.): 21-32 | DOI: 10.3849/2336-2995.25.2016.03.021-032 This article aims to reflect a digression into the history of selected strategic documents, which processed the Ministry of Defence or was in the processing involved - in connection to the planning of acquisitions. The ambition of the article is not a comprehensive evaluation process, but only the selected aspects. After many years of decreasing Czech defence budget, is here the opposite situation. In connection with the new situation it is necessary to rethink the current approach to this topic; to ensure maximal security of the Czech Republic and in a figurative sense NATO and the European Union also. The fact, that the Czech strategy document was among the best in the EU, does not mean that defence spending is automatically efficient. |

Pacifism and Manning Armed Forces of the Czech Republic by Reserve Soldiers in Time of Threat or WarMilitary sociologyMjr. Ing. Bohuslav Vlček, Ph.D.Vojenské rozhledy / Czech Military Review Nr. 1/2009, Vol. XVIII. (L.): 159-161 Pacifism, opposition to war and other violence, is both organized political movement and individual ideology. Pacifism varies from a form that is absolute and doctrinal to a relative and more practical form. Absolute pacifists are against all wars and against violence in any form whatsoever; relative pacifists are selective of the wars and violence they oppose. Most absolute pacifists stress the immorality of the taking of one person's life by another person. The philosophy of pacifism has been propounded throughout history on grounds of morality, divine will, or economic and social utility. The probable impact of pacifist theories on the Armed Forces is discussed in this article, as service in our forces is set by the law and inner normative acts of the Ministry of Defence. |
Defence strategy: Vision of ResponsibilityNonreviewed - ResearchIng. Josef OpluštilVojenské rozhledy / Czech Military Review Nr. 4/2012, Vol. XXI. (LIII.): 3-5 The new ten-year defence strategy of the Czech Republic has been approved. The document stresses that despite the continuing recession, our state should not allow the military being weakened by further reduction of resources. This could worsen the quality of the military and weaken the Czech Republic's credibility in the international community. There is also the risk of the financial, organisational and personnel destabilisation of the Czech defence system that would bring about a loss of the quality of military personnel, a decayed prestige of the military service, an erosion of the state military capabilities. The new defence strategy is not a cure-all medicine. By its adoption the real |

The Cyber War ContinuesInformational pagesPhDr. Antonín RašekVojenské rozhledy / Czech Military Review Nr. 4/2012, Vol. XXI. (LIII.): 73-89 The author summarizes present-day knowledge of this problem. Worms and viruses have transformed to serious security challenges and perfect instruments of cyber espionage. They have become a tool in information warfare. Cyberattacks transformed to risks calling only for technical responses. The growing awareness of the seriousness of the cyber-threat is enhanced by incidents, e.g. the malware "Stuxnet" attacking the Iranian nuclear programme. Actually, cyber space is regarded as a fifth dimension of military deployment, apart for land, air, water, and cosmos. Some nations are already investing massively in cyber capabilities that can be used for military purposes. Most Western nations have considerably stepped up their defences in recent years and are forming special units for cyber warfare. |
Military Bias CrimesMilitary lawDoc. PhDr. JUDr. Miroslav Mareš, Ph.D.Vojenské rozhledy / Czech Military Review Nr. 3/2012, Vol. XXI. (LIII.): 140-147 | DOI: 10.3849/2336-2995.21.2012.03.140-147 This article analyses a new element in the Czech criminal law-Military Bias Crimes. They are included in the new Criminal Code 40/2009 Coll., Sect. XII. The bias motive is characterized by a prejudice against race, ethnicity, nationality, political belief, religious belief or atheism, but not against the so-called sexual orientation, in contrast to the situation in the US. Perpetrators of some military bias crimes, § 378, § 379, § 380, can be not only soldiers, prisoners of war, but also members of security corps (Police, Security Intelligence Service etc.). Up to now, the use of these new norms of the Czech penal law has been limited. |
