Some Tools of the Czech Republic Security Policy to Prevent Proliferation of Nuclear and Chemical Weapons

The article deals with selected international treaties, current agreements and international cooperation initiatives in the field of non-proliferation of nuclear and chemical weapons, in which the Czech Republic is represented through specific bodies or ministries. There is also a general description of the view and the specific military approach. The involvement of the MoD and the Czech Armed Forces in NATO structures enables to influence the strategic decision-making in the area of CBRN and thus support the current trends concerning forensic analysis, sampling of CBRN samples and response to new trends in the field of WMD elimination.

Implementation of Capability Assessment Process within the Armed Forces of the Czech Republic

The article thematically completes a series of articles which subject was to present outcomes of analyses focused on national as well as NATO and EU capability planning processes. Synthesis of analysis outcomes resulted in conceiving a methodologic framework for military capability assessment, whereas the first phase of this framework, i.e. configuration of the national capability requirements database, has been already described in the previous edition of the Czech Military Review. So this article details final phases of the proposed methodological framework, which are set of reference units and mechanism for matching capability requirements against current state capabilities. The key outcome of capability matching phase is identification of capability shortfalls and their subsequent prioritisation. The level of priority is expressed as a degree of operational risk and relates to an expected intensity of operational engagement of force units in military operations. This approach stems from the principle of the capability assessment process which shall be carried out by military experts and which deals exclusively with an expected military end-state in operations.

The article deals with the Information Support of Human Resources Management of the Ministry of Defense in terms of providing information on the quantity and quality of the personnel of the department for decision making processes. The first part describes the tools and methods of analysis for processing this information. The second part provides practical examples of this information support. On the basis of analytical studies the status of staff is presented in 2015 and 2016, supplemented by comments from the author, indicating possible ways of presenting and using this information in Human Resource Management. The author of the article, which presents the results of the long-standing experience of the creator of the information management support system, concludes that the data generated by this system could lead the adoption of a number of fundamental strategic decisions.

In April and May this year, several articles or essays appeared in civilian media, introducing misleading information that in the near future, the ranks of ordinary servicemen (privates, corporals, sergeants) are coming back, as they were abolished after introducing professional forces. Such proclamations are not quite true, because ranks of private, corporal and sergeant, were earmarked by legal rules above all for soldiers in their compulsory or compensatory military services, i.e. they were not abolished after 2004. There are a lot of similar uncleanlinesses as far rank corps are concerned and therefore the main attention of this article is concentrated on changes that in connection with Act No. 221/1999, Coll., Professional Soldiers, amended and updated in 2009, has come into being.

The aim of the article is to make the general public acquainted with a new view of the state service issue and to offer the author´s observations and conclusions relating to state service issues. The article briefly explains the public service and defines the relationship between the public service and the state service. It describes the organization of the state service and the entities of service relationships in the Czech Republic. It deals with the employment relationship - its origin, non acceptance for employment relationship and its termination. It presents important milestones of the employment relationship, such as an oath of service, a clerical exam and a service evaluation. It characterizes the state service within the Ministry of Defence, clarifies the role and responsibilities of the Secretary of State within the Ministry of Defence, state employees and other categories of the staff in the service office.

Abolishing military courts at the end of 1993 could evoke the idea that there is no such thing as military judicature in our country. In fact, the Defence Act sets that in time of military preparedness, higher and lower field tribunals and courts come into existence. But present legal norms do not know the legal term "state of military preparedness", only "mobilization". There are many other legal gaps, concerning e.g. declaration war, defining state of war, proclaiming martial law. There are not firmly set statutes of field military courts, their subordination, dependence of field judges and their assistants, or how shall we handle offences of our soldiers abroad, its connections with international laws and agreements. This state of affairs for quick remedy.

The paper deals with general aspects of problems of biological warfare agents and toxic industrial biologicals understanding from the point of view of protection against their effects and a possibility of specialists´ cooperation. The aim of the paper is to point to some problematic aspects of biological defense realization in connection to experiences from their historical usage. Manning Czech armed forces in peace, in time of danger or war, are backed by law regulations and DoD internal normative acts. In fact, Czech legislature is still insufficient, so the author advises its revision. Laws concerning defence ought to be timeless, further amendments beg the questions concerning their correctness. When the institute of ?Conscientious Objector? was established in 1990, the figures of soldiers in their compulsory service were reduced by 15-20 % of planned numbers. The membership in an established sect, background as an active pacifist was not required for an objector to be eligible for exemption from military service. Greece (the Hellenic Republic) is one of a few European countries still preserving the compulsory military service for all Greek young men even in time of peace. As conscientious objectors are not regarded those who served in armed forces in the past, who are legally entitled to own a deadly weapon, or were prosecuted or sentenced for an offence tied with arms. The author suggests adopting similar arrangements like in Greece.

When planning and conducting tactical exercises of units and formations, it is often the case that aspects of long-term operations in a chemical, biological or radiological contaminated environments have disappeared from consideration of commanders and staff officers. The reluktance to "complicate the situation" in training may have different causes, but the continuing importance of CBRN defence is indisputable. The article discusses probable commander questions related to the effective management of subordinate units in a contaminated environments. Their answering can help to successfully fulfill defined combat tasks that have been disrupted by the use of enemy weapons of mass destruction, improvised devices containing highly toxic substances, or leakage of industrial hazardous substances into the environment.

Results of Research to the Issue of Engineer Support in Combat Operations

The paper deals with the ability of engineer units to provide engineer mobility support in combat operations. Based on the analysis of the results of structured interviews conducted with extensive amount of the Czech Armed Forces officers, and their generalization, were found discrepancies between the current and required state in the organizational structure of engineer units to provide effective mobility support, and requirements for engineer devices to support mobility in the Czech Armed Forces conditions were formulated. The aim of this article is to present recommendations for inclusion of different types of engineer devices into formed engineer formations for mobility support in relation to the tasks performed within engineer role of mobility support and determine recommendations for the further direction of research in this area.

The article deals with the general considerations on the relationship between Public and Private Law and on the relationship of the Professional Soldiers Act (Act no. 221/1999 Coll., on Professional Soldiers) to other legal regulations. The contribution also defines and interprets certain terms (family, household/shared household, close person, child, spouse/partner) at which demonstrates the combination of both legislative branches. It attempts to demonstrate that the laws so called armed legislation, particularly the Professional Soldiers Act is not a world closed on itself, but rather an area that is a part of the unified legal system linked to a number of laws, including Private Law (especially to the CivilCode and Labour Code).

Armed forces, civilian employees, are extremely exposed to unwanted effects of socially undesirable behaviour, as they live and meet their assignments under difficult conditions, e.g. in mission abroad, separated from their relatives, spouses, wives. The best deterrence against socially undesirable behaviour is its prevention. Legally this problem is defined in the Defence Minister Order No 53/2010, The Prevention of Socially Undesirable Behaviour. According to the author M. Hrbata, Deputy Defence Minister for Personnel, we must deal with this problem in a multidisciplinary manner, in the frame of effective organizational structure, run by competent commanders, chiefs, directors, with natural authority.

Article analyzes the relation between legal and internal regulations and acts in public administration focusing on their hierarchy, quantity, liability in specific area of armed forces. There is wide range and amount of relatively autonomous service regulations and official channels (internal orders, guidelines, advices). Although any internal regulations have to be in accordance with superior sources of law, relation between legal and internal level is not clear. Article exemplary outlines, that consistent system of internal rules is based especially on running and immediate updates to meet harmony with legal code.

The paper deals with recent recodification of private law (background and sources of inspiration, general part of Civil Code, family and inheritance law) and particularly the special regulation related to the members of the armed forces (so-called military private law): 1) marriage under exceptional circumstances (§ 667 CC), and 2) military testament (§ 1545 CC). They reflected illustratively the ideological background of the recent recodification - links to national and European legal tradition, discontinuity with the previous regulation and the pursuit of complexity, and also indirectly the current relationship to the armed forces - respect, appreciation of their importance and taking account of their specifics.

On April 1, 2001, a new management regulation of Czech Defence Ministry came into force. The previous one was in existence for more than twenty years, it was known as the PT-1-1 (Těl-1-1), "Physical Preparation in the Czechoslovak People's Army". Approving this new management regulation was not easy. It was revamped many times; there were several experts' opinions contrary each other, the Czech legislation changed once or twice. The final product is a compromise, setting testing norms at a level of the year 2000 standards; PT preparations imitate mostly military exercises. This article familiarizes the readers of Military Review (Vojenské rozhledy) with the new norms of PT testing, standards, new PT tablets, and schemes.

The process of the Lessons Learned in the Czech Armed Forces is not ideal for several reasons. One of them is the underestimation of the process by top management. Another one is the low level of awareness of the process, institutions, possibilities and importance of the Lessons Learned Process as a whole. The aim of this article is to clarify the Lessons Learned Process as a tool to support the organization. The first part of the article deals with the process of the Lessons Learned in the Czech Armed Forces including terminology. The second part of the article describes the factual implementation of the Lessons Learned in the Czech Armed Forces. It points out achievements as well as drawbacks during its implementation. In addition to that, it introduces the current Czech military publications dealing with this topic. The conclusion presents the description of some suggestions and recommendations for further development of this process.

The Control of Surplus Military Materiel

The term "military materiel" covers equipment and supplies, i.e. articles which soldiers need in order to carry out tasks (clothing, radios, tools, weapons, vehicles). Guarding, attendance, maintenance and preservation, transport, storage, cost a lot of money that could be used in another way, so the Czech Army must sell them out. The author quotes legal rules and military manual dealing with this matter. He differentiates between solely military items (weapon systems) and those that may be used for civilian purposes. Unfortunately, military manuals do not precisely specify those categories. At the end he demands developing legal norms giving a definition of military materiel, including the list of such materiel, in a form e.g. an amendment, which could be updated every year.

One of the objectives of the project for organization development titled "Trends in development the Armed Forces of Czech Republic in relation to the development of the security environment", is to identify trends in career management and life-long education in the MoD. The article presents partial findings of the substudy focused at proper use of management methods to execute primary data collection and to construct complete problem formulation for both preparation and implementation of Career Order as a part of human resources management in the Ministry of Defense. There is summary of methods and tools used for problems formulation in the first part, the second part shows how these methods are applied in practice. Based on results, the conclusion is then formulated depicting the primary problem of preparation and implementation of the career system.

The behaviour of an individual is (apart from mental elements) influenced by plenty of social events. Within the process of institutionalization of behaviour, normative orders are being established. The normative orders are defined as sets of rules, i.e. rules prescribing a certain ways of behaviour. There are legal, moral, religious, political, courtesy and aesthetic rules. The legal rules are the principal and integral rules for the soldier. The legal rules are defined as binding, specifically expressed and by state power enforceable rules of behaviour. The obligation to adhere to the legal rules is prescribed by constitution as well as by laws. In spite of the fact that laws do not expressly prescribe the obligation to adhere to the moral rules, these are indispensable for the soldier. The laws directly solve potential conflict between duties of soldier with religious and political rules. The laws also prescribe the commitment to adhere to the courtesy and aesthetic rules. The purpose of the all above mentioned regulations is to assure that soldiers will carry out their legal duties; they will behave morally, and respect laws and courtesy rules.

The lecture discusses the possible forms and methods for further development of Population protection, focusing on implementation of measures to protect the population at higher crisis status. The aim of the lecture is to analyze possible priorities, resources, and procedures for population protection in serious and large-scale crisis situations using all available forces and capabilities of the State and citizens. The work also deals with the possibility of more effective measures of population protection during announcement of higher crisis status generating additional forces and means and methods for the management of these measures. The aim of the work is among other things to point out the fact that the measures of population protection must be prepared in perspective and comprehensive and must reflect the potential risks, including the large scale crisis, which may be occur in the territory.

This paper aims to enrich professional discussion on future shape of the Armed Forces of the Czech Republic (AFCR) and is linked to the preceding research and publishing activities of members of the Centre for Security and Military Strategic Studies (CBVSS) at the University of Defence. In its first part, it performs a historical tour to the year 2012 and highlights the reasons that the former leadership of the ACR led to the start of construction work on the concept of AFCR (KVAČR). Briefly describes the interconnection and the hierarchy of individual conceptual and strategic documents, the procedure works on them and summarizes the arguments supporting the need of KVAČR as such. The next section brings potential methodological approaches to the preparation of this document, using the method of the "9S", including practical examples, it renumbers basic strategic assumptions and priorities in various stages, bordered by years 2020 and 2025 as a prerequisite for formulating strategies for achieving this specific goal. Within the document, there is a short excursion into the field of long-term planning for major areas of skills, using their description of DOTMLPFI functional areas, including an example of using this methodology in project preparation of program funding. The recommendations formulated in the article are based on the authors' best experiences with the preparation of documents of a similar type in the years 2003-2013, the recommendations of experts from the broader security community of the Czech Republic, and recommendations of the Alliance. As such, it has been passed to the KVAČR processors at level of the General Staff of AFCR over the years 2013-2014.

The Creation of Lowest Army Rank Corps

Army personnel are ranked according to level, from the lowest (privates, sergeants, WOs) to the highest (officers, generals). A total of 80 per cent of professional soldiers, in lowest ranks, are hired at labour market. They form the core of our military personnel, so that they have to be properly taken care of. But in ours, we have still the mentality of mass armies of cold-war period. There have been professional armed forces in the Czech Republic for more than five years, nevertheless the question how to build up the other rank corps is still opened. This article deals with this problem and the method how to cope with the need to form more professionalized NCOs. Broadly speaking, it is the question of the quality overpassing the quantity. Author insists that the British model of NCO's career path should be easily applied into the Czech Armed Forces to get rid of the obsolete recruiting related more to a model of conscription forces.

Everyone Has the Right to Refuse (Pacifism, Registered Denominations and Church Societies)

The study deals with pacifism in programmes of church denominations and societies acting legally in the Czech Republic and its supposed influence for manning Czech forces by retired ex-servicemen in times of war. During the state of emergency, war danger or even a war, the armed forces will be replenished by retired servicemen that under actual Defence Act are obliged to rejoin the forces. Today, all men, citizens have a legal right to refuse to serve in army. We have an official list of 32 church denominations; all of them have a special policy towards war, defence, and military service. The author asked denominations to reply several questions concerning their attitudes to country defence and military service. Their answers and evaluations present the contents of this article.

The authors analyze legislative and social surroundings upon which the humanitarian assistance is rendered by the Army of the Czech Republic. They characterize various forms of non-governmental organizations in our country and the conditions under which the Czech Army is allowed to cooperate with them. There are many special features in providing assistance, namely as far as members of various church denominations in the Czech Republic are concerned. The list of selected denominations with their short profiles is enclosed.

Each officer is obligated to meet his or her qualification requirements, identified in the job description. In order to obtain a required military qualification, officers are usually send to a training course, which is either provided or organized under the auspice of the Ministry of Defence. The discussion within the Armed Forces of the Czech Republic about the system of military courses has been ongoing for the last two decades. Although the system of officers´ development is periodically reviewed, a certain economic paradox still remains. While the number of officers without adequate qualification is not diminishing, at the same time there is a segment of officers who exceed their qualification requirements, but they do not make any progress in their military careers. Despite the situation, these officers are required to take additional training and educational activities.
