(LXV.): 110-128 | DOI: 10.3849/2336-2995.33.2024.03.110-128 The article deals with the comparison of refunds of non-material damage in public and private area. In the public area is analyzed legal regulation on health injuries in service relations, in private area is discussed legal regulation on health injuries in civil law and labour law. Particular attention will be focused on the transfer of compensation in the event of injury to the heirs - while in service relationships, such claims are extinguished by death (not transferred on the heirs), which was taken over from the 1960s legislation, in current private law, do not cease if they have been recognized or at least brought in court. The aim of the paper is a critical analysis for the current state of legal regulation and the proposals de lege ferenda (approximation to labour law regulation). The issue has increased importance for public finances and functioning of public sector and enforcement of the rule of law. |
The Security-Development Nexus in Practice: Lessons Learned from the US Provincial Reconstruction Team in Panjshir in AfghanistanReviewed - ReviewZdeněk RodVojenské rozhledy / Czech Military Review Nr. 1/2024, Vol. XXXIII. (LXV.): 105-126 | DOI: 10.3849/2336-2995.33.2024.01.105-126 The article holistically assesses the US application of security-development nexus (SDN) through the most known example of SDN in practice - provincial reconstruction teams (PRTs) - to elucidate what lessons learned can be drawn from there. The PRT's unique small footprint approach aimed to skip combat phases and focus on development in Panjshir. The research detected fourteen lessons learned from PRT's Panjshir wrongdoings and relatively successful initiatives. Lessons learned include defining mission objectives, early identification of instability sources, unified funding, emphasis on security sector reform, cultural awareness, empowering locals, and continuity in leadership and mission. PRT Panjshir's approach is debated, emphasizing managing, not fully resolving, complex conditions. Depending on contextual factors and learned lessons, the model's duplicability in future conflicts remains uncertain. |

(LXIV.): 23-34 | DOI: 10.3849/2336-2995.32.2023.02.023-034 The article is devoted to the draft law on defence financing, which aims to oblige the government to allocate an amount of at least 2% of GDP to defence in every draft law on the state budget. During the inter-ministerial comment procedure, the Supreme Audit Office expressed doubts whether the draft means anything more than an unenforceable political commitment in relation to the Chamber of Deputies". The article convincingly demonstrates, with the help of legal argumentation and interpretation of the Constitution of the Czech Republic, the Rules of Procedure of the Chamber of Deputies, as well as the established case law of the Constitutional Court of the Czech Republic, that if approved, the Chamber of Deputies will also be bound by the Defence Financing Act when approving the state budget. To do otherwise would violate constitutionality. |

Deception Planning is an iterative process that should be considered as an inextricable part of the operational planning. The knowledge in the field of military deception in the Czech military is low; no operational deception plan has been prepared for foreign operations or any military exercise. Deception is widely appreciated as a powerful instrument of military operations, yet it is surprisingly neglected by both the Czech Army and Military Educational System. The author tries to encourage officers and members of higher staffs to study this subject. |

(LII.): 71-96 This article deals with PMSCs as a relatively new phenomenon in warfare areas. It is open to discussion whether private military companies and the private contractors that they employ, should be treated just like any other transnational industry, or whether they should be treated like mercenaries under international law. As it happened in many countries, private companies and private contractors operate in a legal vacuum. From a strictly legal point of view individuals employed by private military companies are not to be considered as mercenaries. The private military industry offers a wide range of services. Procurement of military services by individuals and private firms has developed in a direction that had probably not been anticipated in previous years. Some military analysts say that the exclusive role of the state in the domain of defence and security is outdated and should be re-examined. |

(LXIII.): 159-171 | DOI: 10.3849/2336-2995.31.2022.04.159-171 The article describes the reasons that led to the development of the implementation tool for development projects used by the Czech Ministry of Defence to simplify the planning processes and the experience of its users with the tool. Modernization of the army is one of the basic building blocks needed to achieve the goals set by the state's security strategies. A comprehensive approach is necessary to perform many consecutive activities, such as project management, risk management, and others. To streamline the processes needed for the preparation and planning of development projects, the Czech Armed Forces issued a methodology to create an implementation plan for the acquisition of new military equipment in 2021. The purpose of this article is to present the results of the analysis of experience with its annual use in practice. |

(LXII.): 26-38 | DOI: 10.3849/2336-2995.30.2021.02.026-038 This paper aims to explain the tension between the phenomenon of whistle-blowing and military values, embodied in core martial virtues of loyalty and courage, which are integral in all armies. By defining these virtues in the military context, the author demonstrates how expressing dissent in the military is not necessarily opposed to loyalty and courage, but rather that it is necessary if conflict of different loyalties is properly managed and if courage is properly understood. Only by ensuring that armed forces are led by those who truly understand military values and martial virtues, and that whistle-blowing can be both patriotic and heroic, can we strive for a lasting peace. By courageously expressing loyalty to his nation, institution and profession, a soldier may act heroically by blowing the proverbial whistle. |

There were various contributions on its pages, which criticized the lack of the Czechoslovak military doctrine. The corn of criticism was also aimed at non-systemic arrangements based on Soviet pressures in the area of diplomacy and military policy. Vojenská mysl reflected carefully the general process of democratization, which influenced the daily life in the Czechoslovakian army. The democratization required involvement of scientific base in military affaires, a long with better use of personnel capacity in the military. |

In second step, this study compares 10 selected NATO countries Defence Strategies in terms of identified risks and threats, future military capabilities to counter threats, processes of drafting defence papers, level of details and approving authorities. Outlining these indicators and characteristics provide useful overview for future draft of National defence strategies within countries of similar size. |

The used methodology based on combined approach founded on selected competency rosters and its further modification seemed to be relevant and applicable in the Czech Armed Forces conditions. Military officer's profiles anchored in the EU Commission Database for Armed Forces and in the EU Sectoral Qualifications Framework for Military Officer Profession have been proven as the most relevant frameworks of competencies. Both are formulated and structured to be as generic as possible for all officers regardless of their specialization. They were established on current theories and incorporate extensive amount of entries from various national sources. The resulting list of 24 generic competencies, selected from a total of 69 competencies analyzed, represents a possible example of a set of requirements imposed on the Czech Armed Forces officers. |

(LXV.): 91-109 | DOI: 10.3849/2336-2995.33.2024.03.091-109 The annual examination is an integral part of the physical training system of a soldier of the Army of the Czech Republic, which assesses his physical fitness. This assessment provides dual feedback - it informs examinees of how they are performing against normative tables and each other, and at the same time, gives commanders an idea of the current physical fitness of their subordinates. This thesis focuses on the endurance event of the 12-minute run (also known as the Cooper test). Based on data from 2011 to 2021 and nearly 50,000 evaluated tests, the potential effects of age on soldiers' physical performance and appropriate adjustments to individual age limits were examined. The analysis showed that the difficulty setting for achieving the same rating differs for both genders and that there is a different decline in physical performance with increasing age than reflected in current norms. Based on these analyses, a proposal for modifications to the annual physical training test was developed and is appended to this paper. |

(LXV.): 3-17 | DOI: 10.3849/2336-2995.33.2024.02.003-017 The article deals with Turkey's trust in the USA as its most important ally in NATO. Semi-structured interviews with Turkish academics and international relations experts during field research identified three main areas of Turkish mistrust in the USA - the Cyprus question, USA support for the PYD/YPG in Syria, and USA intervention in Turkish politics. The research results presented in the causal network show that the main cause of Turkish mistrust towards the USA is the factors leading to the phenomenon of fear of abandonment. That causes Turkey's increased need for independence from strategic partners and the subsequent increase in the application of a balance policy. The study concludes that one of the main reasons for Turkey's current attitude towards NATO is the need to ensure its security, and this need stems from Turkey's mistrust of the USA. |

Within the framework of international security relations, this is a very unstable and conflictual region, where this instability has lasted practically since the establishment of the State of Israel in 1948. The global UN, its overall activity and importance, especially humanitarian and peace-building activities not only for the Near and Middle East region, is very beneficial, through out the Cold War period up to the present day. As a security organization, NATO is among the most important global actors influencing current international security relations. Through their activities, both of these organizations represent a essential means of ensuring world peace and security. |

(LXV.): 56-76 | DOI: 10.3849/2336-2995.33.2024.02.056-076 Most experts believe that urban operations will gain importance in the future, but even though we have sufficient examples and experience at hand, we still struggle with the development of the necessary skills and capabilities. The resulting gaps are a combination of different tasking and shrinking resources in the past decades, the difficulty of training for and a mere misunderstanding of the urban environment and harmful innovations - we seem to find ourselves always in the beginning. Fighting in isolated "prisms of responsibility" requires flexible task forces with all necessary enablers at hand and well-trained commanders exercising mission command and understanding their role, task, and the purpose of action. Mastering the urban environment on all three levels of movement is a very challenging task and requires focused attention on various aspects, inter-actor interaction and interdisciplinary research and development. The development of a methodology suitable for looking into the hidden aspects and contextualizing them with current activities and future developments is key to capability development. |

The paper therefore focuses on incendiary balloons, a weapon that repeatedly caused fires around the Gaza Strip between 2018-2023. It examines their history, their design, outlines the possibilities of their elimination, the advantages and disadvantages of possible technical solutions, and a reflection on the future of their usage. |

The article further addresses the issue of fragments scattering when using a charge to overcome chain-link fences. The introductory chapter describes the execution of training in this field using the exercise facilities that are built for this purpose in military training areas. When conducting explosive forcible entry training, the safe distance for intervening teams and non-participants is determined using given formulas. The purpose of the simulation, mathematical calculations and experiment was to assess the extent to which fragments scattering occurs during explosive overcoming of these fences and whether the procedures used to determine the safe distance for non-participants are sufficient. |

(LXV.): 21-39 | DOI: 10.3849/2336-2995.33.2024.01.021-039 The article brings a comparison of the approaches to the strategic defence analysis (SDA) and developing future Defence Concepts (DFDC) of the Czech Republic and Norway. The countries are in a different geopolitical situation, NOR being a country with borders that are part of the outer border of the Alliance, the Czech Republic being a country surrounded by three member countries of the Alliance and one PfP country. On the basis of the comparison of the two approaches, the authors identified differences and common points of the two. Based on the findings, the discussion provides inspiration for possible enhancements in the approach of the Czech Republic to SDA to ensure the future defence of the country. All that in context of current Security developments in Europe, that have an impact on how NATO member countries might deal with Article 3 and Article 5 of the Washington Treaty. |
Active Measures Concept Deconstruction Through the Lenses of Information InfluenceReviewed - ResearchMiroslava PačkováVojenské rozhledy / Czech Military Review Nr. 1/2024, Vol. XXXIII. (LXV.): 40-62 | DOI: 10.3849/2336-2995.33.2024.01.040-062 This study deconstructs the concept of active measures through the prism of information influence. It understands it as sophisticated methods of influencing public opinion and political decisions, originally used by the Soviet Union and now adapted to cyberspace by the Russian Federation. In the analysis, the concept is contrasted with the general abstraction of information influence. This helps to better understand the proximity of active measures to similar concepts. We conclude that abstractions of information influence are also valid for conceptual understanding and practical examples of contemporary Russian active measures. Active measures are subsidiary to information influence, serving as tactical means to achieve the latter's strategic goals. Furthermore, the author states that the information environment is the operational theatre for active operations, cyber operations can be its manifestation, information operations support as a key component of a broader information operations strategy, and psychological operations are its critical element. |
Cognitive Warfare as a New Dimension of Security. The main difference consists in the targeted and sophisticated use of scientific knowledge from neuroscience, with special attention on consciousness and perception of reality. This deeper understanding of how the human mind works has impacted distributed narratives and the choice of the most suitable technological platforms for their distribution to the target audience. This article presents a conceptual classification of cognitive warfare and defines its three core segments: neuroscience, technology and aspects of social science. |

(LXV.): 84-104 | DOI: 10.3849/2336-2995.33.2024.01.084-104 The article focuses on the concept of crowdsourcing in the social networking environment as a new phenomenon involving civilians in the intelligence process, enabling the use of their intelligence potential during armed conflict. Crowdsourcing of the civilian population is introduced by the example of NATO intervention during the first civil war in Libya. The article presents its use during the intelligence process at the strategic-operational level of command and control of the armed forces. It establishes its possible definition as a collection method of the intelligence process, and as a collection method which is disjunctively separable from similar intelligence collection methods. |
